The Changing Role of the Architect in Construction Contract Administration: CM Advisor vs. CM At Risk

As the marketplace has become more focused on the financial impact of decisions made throughout the design and construction process we have seen owners relying more heavily on either Owner’s Reps or CM Advisors. Each of these has played an increasing role in controlling the process. In addition there is increasing reliance on the CM at Risk, another name for the General Contractor.

This session will explore the impact of these players on the Architect’s role primarily during Construction Contract Administration. We will look at what is the Architect’s responsibility and what is the expectation of the other team members.

Learning Objectives

  1. Learn the history and evolution of the architect's role as practitioner in varying project delivery modalities.
  2. Learn what owners and constructors expect of architects. Learn what architects' real contractual responsibilities are.
  3. Learn what liabilities architects face as systems evolve and roles change.
  4. Learn the current state of the practice and reality in the field during construction.

At the conclusion of the webinar, a link to a survey/CES report form will be provided. All attendees at each site will submit one form: 1) page one: webinar survey and 2) page two: CES report form. AIA members and IDP record holders (http://www.aia.org/FreeTranscriptsforInterns) will have their credit recorded within one week of the webinar. All attendees will be prompted to download a certificate of completion at the end of the survey.

Speakers

Burton Lloyd Roslyn, FAIA, FARA, DBIA has dedicated his practice to the development of an atmosphere where the architect is recognized as the true leader in the processes of Design Build and Project Management. Through his advocacy he has fostered recognition of the role architects play in this process. He has become a strong voice in the conversation on the control of the process through expansion of the architect’s role. His vision also translates into teaching the next generation the reassertion of their role as “Master Builders”.  He has operated in areas that bridge the gaps between architect and builder and architect and owner. Roslyn’s foremost accomplishment has been as advocate for and practitioner in what are the new paradigms: Integrated Project Delivery and Architect led Design Build. His tireless activism has instigated concrete change in both legislative and practice arenas. 

He is recognized for his achievements in planning, development and construction. Roslyn has helped produce Design Build projects ranging from commercial offices to an international retreat center each incorporating many of the principles of Integrated Project Delivery on a nationwide basis. As a practicing architect and leader in the Design Build process, Roslyn brings the unique perspective gained by bridging the world of the designer and builder together.

 

Bill Schmalz, AIA, CSI, CCCA, Assoc. DBIA, LEED AP is the Technical Principal in the Los Angeles office of Perkins+Will. Since joining the firm in 1980 as a technical architect, he has led teams on a wide variety of project types, including healthcare, education, research, transportation, and commercial. His expertise is in contract documentation, contract administration, and construction cost management. He co-chairs the committee that develops and establishes firm wide standards for project delivery, quality control, contract administration and project management. Since 2008, Mr. Schmalz has been an instructor in the CSI CCA training program in Los Angeles.

Steven Shapiro, as an engineer and lawyer, has a distinct experience in the interplay of construction and design as well as project development.  At The Whiting-Turner Contracting Company, Mr. Shapiro is a project manager and serves on the company’s national historic preservation group and its national LEED group.  He has served as construction manager and superintendent of hotel, commercial office, and embassy projects.

Before construction management, Mr. Shapiro formerly practiced law, representing national and regional development entities.  He served as lead counsel in the acquisition, financing, construction, and leasing of properties including retail, commercial office centers, and multi-family projects.  In addition to development entities, he represented equity funds, commercial lenders, and mezzanine investors.

At the University of Maryland, Mr. Shapiro has taught Real Estate Development for the Contractor in the School of Engineering and Construction Management for the Professional Developer in the School of Architecture.  He has also taught construction law at the American University school of law.  Mr. Shapiro is the author of Maryland Real Estate Laws Annotated (West), and the author of Maryland Business Laws Annotated (West).  In addition, he is the author of articles published in scholarly journals and has been invited to panel presentations on topics relating to design, construction, and sustainable development at national venues such as the International Council of Shopping Centers, Carnegie-Mellon University, and the University of Florida.

Mr. Shapiro earned an undergraduate business administration degree from Georgetown University in 1984, a law degree from the Georgetown University Law Center in 1987, and a Masters of Law degree from Georgetown Law Center in 1991.  In 2004, he received a Masters Degree in Engineering from the University of Maryland.

 

Bruce Nelson is a Partner at Nelson+Okerlund Project Management and has over 28 years of experience in planning, project and construction management. Nelson has held various positions in the construction industry including Project Manager, Project Executive, Operations Manager, Vice President, Preconstruction Director and General Manager. This wide variety of construction industry expertise from both a contractors’ and owners’ perspective enables Bruce to provide exceptional service and deliver first rate solutions to his clients.

Prior to forming Nelson+Okerlund Project Management, Bruce was Vice President of Business Development for McCarthy Building Companies, Southern California.  He also previously worked for Turner Construction as Operations Manager for Healthcare Southern California.

His background includes a depth of healthcare experience, including OSHPD hospital facilities, surgery centers and long-term acute care facilities. Bruce has also managed projects for education, government and corporate facilities, as well as for commercial, retail and development clients.  His past service in the United States Air Force has facilitated Nelson+Okerlund’s status as a Service Disabled Veteran-Owned Small Business (SDVOSB.)

Bruce’s considerable knowledge of project development and construction management led him to participate in various industry conferences as a highly regarded keynote speaker, as well as contribute to numerous prestigious business publications.

 

Michael Beirne of Turner Construction. Prior to college Beirne worked with a builder on Long Island and became familiar with all types of residential construction and materials. It was during this time he developed a love of the construction industry that would last a lifetime.

After graduating from New York Institute of Technology with a degree in Architecture he worked with local architects until taking a position in an international architectural firm in Manhattan. While at HLW International Beirne helped establish HLW Design Build LLC and did an auditorium for Jack Welch at General Electric, headquarters for Crain Communications in NYC and Chicago and bicoastal training centers for MetLife in Secaucus and Los Angeles among many other design build projects.

The design build experience led to a position at Turner Construction Corporation as a project executive. While at Turner Beirne has had the good fortune to have worked at the new World Trade Center site, to have built the interiors of the new Yankee Stadium, and to have worked with Frank Gehry on the IAC building.

These experiences and Beirnes’ love of construction has contributed to a unique and hands on knowledge of the construction process literally from drawing board to completion. He has contributed to some of the most challenging construction projects in the tri-state area and continues champion a design led construction process.
